THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

I. OUR COMMITMENT TO YOUR PRIVACY
This notice explains how Lindsey Kohn, LMFT ("I," "me," or "the Practice") uses and discloses your Protected Health Information (PHI) for Treatment, Payment, and Health Care Operations (TPO). I am required by law to maintain the privacy of your PHI and to provide you with notice of my legal duties.

II. PROTECTIONS FOR SENSITIVE RECORDS (42 CFR PART 2)
As of February 16, 2026, federal law provides enhanced protections for records concerning Substance Use Disorder (SUD).

Legal Shield: SUD records may not be used in civil, criminal, administrative, or legislative proceedings against you without your specific written consent or a court order.

Anti-Discrimination: I am prohibited from discriminating against you based on SUD information I receive.

Redisclosure: Information disclosed pursuant to this notice may be subject to redisclosure by the recipient and may no longer be protected by the HIPAA Privacy Rule. However, SUD records remain protected against use in legal proceedings.
III. LIMITS ON CONFIDENTIALITY & MANDATORY REPORTING
I will only release your information with your written authorization, except in the following situations:

Abuse Reporting: I must report suspected child abuse/neglect or abuse of a vulnerable adult to the Florida Abuse Hotline.

Duty to Warn: If I believe there is a clear, immediate probability of physical harm to yourself or others, I may notify the police or potential victims.

Legal/Court: If you are involved in a court proceeding, your PHI is protected by the psychotherapist-patient privilege. I will assert this privilege on your behalf until I have your written authorization or a specific court order.

Worker’s Compensation: If you file a claim, I must submit necessary reports to your employer or the insurance carrier.

Oversight/Complaints: I may disclose PHI for health oversight activities or to defend myself in a lawsuit or complaint filed by you.
IV. YOUR RIGHTS REGARDING YOUR PHI

Right to Access: You may inspect or copy your PHI. Florida Fees: $1.00/page for the first 25 pages, and $0.25/page thereafter. Electronic copies incur a reasonable cost-based fee.

Right to Request Restrictions: You can ask us not to share PHI for TPO. If you pay out-of-pocket in full, I must honor your request to not share that information with your health insurer.

Right to Amend: You may request corrections to your record in writing.

Right to an Accounting: You may request a list of disclosures I have made (other than for TPO).

Right to a Paper Copy: You may request a physical copy of this notice at any time.
V. THERAPIST’S DUTIES & SPECIAL AUTHORIZATIONS

Breach Notification: I will notify you promptly if your PHI is compromised by a security breach.

Specific Authorizations: I must obtain your separate written authorization for the use/disclosure of Psychotherapy Notes, for Marketing purposes, or for any Sale of PHI.

Fundraising: You have the right to opt-out of any fundraising communications (though this practice does not currently engage in fundraising).
VI. COMPLAINTS
If you believe your privacy rights have been violated, you may contact Lindsey Kohn, the Florida Department of Health, or the Secretary of the U.S. Department of Health and Human Services. There will be no retaliation for filing a complaint.
